  • Speeding

    • Contrary to the Highway Traffic Act, speeding tickets can be found under section 128.

    • Demerit points may be accumulated as a result of being found guilty for speeding. The number of points depends on the rate of speed.​

    • 0-15km over: 0 demerit points

    • 16-29km over: 3 demerit points

    • 30-49km over: 4 demerit points

    • 50+km over: 6 demerit points

  • Handheld Communication Device

    • Contrary to the Highway Traffic Act, use of handheld communication device can be found under section 78.1(1)​.

    • This charge covers any touching, holding, or use of a handheld device while on the road in your vehicle. Penalties for use of handheld communication device depend on driver class, and prior convictions.

    • Penalties for a G-class license are as follows:

      • 1st offence: $500-$1,000 fine, 3-day license suspension, and 3 demerit points​

      • 2nd offence: $500-$2,000 fine, 7-day license suspension, and 6 demerit points

      • 3rd offence: $500-$3,000 fine, 30-day license suspension, and 6 demerit points

  • Disobeying Signs

    • Contrary to the Highway Traffic Act, disobeying a stop sign can be found under section 136(1)(a).

    • This is one of the most common charges issued under the Highway Traffic Act.

    • This offence is committed when you have failed to come to a full and complete stop at a stop sign, which includes "rolling over" your vehicle.

    • Penalties are as follows:

      • 3 demerit points​

      • $85 set fine

      • Conviction on your driving record for 3 years

  • Seatbelt Violations

    • Seatbelt violations can be found under section 106(1) of the Highway Traffic Act.​

    • Seatbelt charges include the driver or passenger of motor vehicle not wearing a seatbelt; not ensuring passengers under 16 are wearing seatbelt; not ensuring toddler is properly secured; driving with an inoperative seatbelt.

    • Exemptions for wearing seatbelt include:

      • Driving motor vehicle in reverse​

      • Medical reasons

      • Engaged in work which requires you to exit vehicle at frequent intervals, with a rate of speed not above 40km/ hour

  • Driving Under Suspension

    • Under section 53(1) of the Highway Traffic Act, every person who drives a motor vehicle or streetcar on a highway while his or her driver's licence is suspended under an Act of the Legislature or a regulation is guilty of an offence, and upon conviction is:​

      • liable to a fine of not less than $1,000 and not more than $5,000; and​

      • for any subsequent offence, a fine of not less than $2,000 and not more than $5,000, or imprisonment of not more than 6 months, or to both.

​

  • Driving Without a Licence

    • This offence is contrary to section 32(1) if the Highway Traffic Act.

    • In order to legally drive a vehicle in Ontario, you must have a valid licence of the appropriate class.​

    • Penalties of driving without a licence are as follows:

      • Fine between $200-$1,000​

      • 3-year conviction on driving record

      • Demerit points

      • Increased insurance premium

      • Potential jail time

  • No Insurance

    • Contrary to section 2(1)(a) of the Compulsory Automobile Insurance Act of Ontario (CAIA), driving without insurance could lead to significant fines.​

    • For the 1st conviction: $5,000 fine + 25% surcharge

    • For the 2nd conviction: $10,000 fine + 25% surcharge

    • Upon conviction, licence may also be suspended for up to 1 year

​

  • Stunt Driving

    • Contrary to section 172(1) of the Highway Traffic Act, ​a stunt driving charge carries severe penalties.

    • Stunt driving conviction will significantly increase insurance premium, and some insurance companies will refuse to insure you once convicted.

    • Immediately upon a stunt driving charge, you will be issued a 30-day licence suspension, and vehicle will be impounded for 14 days. Furthermore, upon conviction for:

      • 1st offence: licence suspension for 1-3 years​

      • 2nd offence: licence suspension for 3-10 years

      • 3rd offence: lifetime suspension that may be later reduced

      • 4th offence: lifetime suspension

​

  • Careless Driving

    • Contrary to section 130 of the Highway Traffic Act, a careless driving charge is normally given as a result of a motor vehicle collision, however, may also result due to "driving without due care and attention."​

    • Penalties upon conviction are:

      • 6 demerit points​

      • A speeding ticket with a fine of $400-$2,000

      • Potential license suspension, and/or imprisonment
